Agreement

These Terms of Use are an agreement between you and Affirm Payments LLC, a California limited liability company ("Affirm Wallet & Exchange", "we", "us"). They apply to the Affirm Wallet & Exchange Android application and to the website at affirmcrypto.exchange.

By downloading, installing or using the application, or by using the website, you agree to these terms. If you do not agree, do not use them.

What the service is, and what it is not

The Affirm Wallet & Exchange Android application displays public cryptocurrency market prices and allows a person to create an Affirm Wallet & Exchange account. It does not provide trading, order execution, deposits, withdrawals, custody, wallets or account balances.

The application does not execute transactions. An order ticket in the application lets you price an order at the current market and see what it would cost. It does not place an order, and no order you enter is transmitted anywhere.

Nothing in the application or on the website is an offer to buy or sell any asset, an invitation to transact, or a solicitation in any jurisdiction where such an offer or solicitation would be unlawful.

Eligibility

You must be at least 18 years old and legally able to enter into this agreement.

You must not use the service if you are subject to sanctions administered by the United States, including designation on the Specially Designated Nationals and Blocked Persons List maintained by the Office of Foreign Assets Control, or if you are located in a jurisdiction subject to comprehensive United States sanctions.

Availability of any service may depend on your location and on applicable law.

Your account

You are responsible for the accuracy of the information you give us, for keeping your credentials secret, and for everything done under your account.

An account must be verified by email before its first use.

Tell us immediately at [email protected] if you believe your account has been used without your permission.

We may suspend or close an account where we reasonably believe it has been used unlawfully, where we are required to by law, or where the account holder has breached these terms.

Market data

Prices, changes, highs, lows, volumes and charts shown in the application and on the website are obtained from a third-party market-data provider.

Market data may be delayed, incomplete, interrupted or unavailable. Prices are indicative and are not quotes, and no price shown is an offer to transact at that price.

Affirm Wallet & Exchange does not warrant that market data is accurate, complete, timely or uninterrupted, and you should not rely on it as the only basis for any decision.

No advice

Nothing in the application or on the website is investment, financial, tax, accounting or legal advice, and nothing in it is a recommendation to buy, sell or hold any asset.

Affirm Wallet & Exchange is not your broker, dealer, investment adviser or fiduciary, and no such relationship is created by your use of the service.

You are solely responsible for your own decisions. Consider taking independent professional advice.

Acceptable use

You agree not to: use the service for any unlawful purpose; attempt to gain unauthorised access to any system or account; interfere with or disrupt the service; scrape, harvest or redistribute market data in a way that breaches the provider's terms; reverse engineer the application except to the extent that right cannot lawfully be excluded; impersonate any person; or use the service to launder money, finance terrorism or evade sanctions.

Intellectual property

The application, the website, and the Affirm Wallet & Exchange name and marks belong to Affirm Wallet & Exchange or its licensors. You are granted a personal, revocable, non-exclusive, non-transferable licence to use the application for its intended purpose. No other right is granted.

Third-party names and marks shown in the application, including the names and symbols of cryptoassets, belong to their respective owners and are used only to identify the asset.

Disclaimer

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

Limitation of liability

To the fullest extent permitted by law, Affirm Wallet & Exchange and its members, officers and employees will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, data or goodwill, arising out of or relating to your use of the service, whether based in contract, tort, statute or otherwise, even if advised of the possibility.

To the fullest extent permitted by law, our total liability arising out of or relating to the service will not exceed one hundred United States dollars (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnity

You agree to indemnify and hold harmless Affirm Wallet & Exchange and its members, officers and employees from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your misuse of the service.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules.

Any dispute arising out of or relating to these terms or the service will be brought exclusively in the state or federal courts located in the State of California, and you consent to the jurisdiction of those courts.

General

If any provision of these terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor to our business.

These terms, together with the Privacy Policy, the Risk Disclosure and the Cookie Policy, are the entire agreement between you and Affirm Wallet & Exchange about the service.
