Bank Secrecy Act obligations
A business registered with FinCEN as a money services business is subject to the Bank Secrecy Act and the regulations made under it at 31 CFR Chapter X. Those obligations include maintaining an anti-money-laundering programme, keeping specified records, and reporting certain transactions and suspicious activity.
Where a service requires it, we will verify the identity of the person using it, and we will say so at the point we ask.
United States sanctions law applies to everything we do. We do not provide services to a person designated on the Specially Designated Nationals and Blocked Persons List, or to a person located in a jurisdiction subject to comprehensive sanctions.
State licensing
Registration with FinCEN is a federal filing. It is not a state licence, and on its own it does not authorise money transmission in any state.
Money transmission is separately licensed by each state. Affirm Wallet & Exchange will provide a service that requires a state licence only in a state where it holds, or is exempt from, that licence.

What the Affirm Wallet & Exchange application does today
The Affirm Wallet & Exchange Android application displays public cryptocurrency market prices and allows a person to create an Affirm Wallet & Exchange account. It does not provide trading, order execution, deposits, withdrawals, custody, wallets or account balances.
Because the application does not hold customer funds, does not transmit value and does not execute transactions, using it does not involve money transmission.

If something has gone wrong, tell us first: email [email protected] or call 304-402-3489. Please include your name, how to reach you, and what happened. We will acknowledge your complaint and tell you how we intend to deal with it.
If you are not satisfied with our response, you may contact the banking or financial-services regulator of the State of California, or the financial regulator of the state in which you live.
You may also contact the Consumer Financial Protection Bureau at consumerfinance.gov, or FinCEN at fincen.gov, which publishes its MSB registrant search so that anyone can confirm a registration.
